2011 Legislative Session
Relating to Medicaid reimbursement policies and the delivery of therapy services   IOTA is reviewing this legislation.
Medicaid has proposed legislation that will change the way services are provided that will also impact reimbursement. Independent providers of OT, PT and Speech Therapy will be aligned with Medicare procedures. The bill also addresses inpatient, outpatient, home health and developmental disability agencies.

IOTA is in favor of the collaborative approach taken by the Department of Health and Welfare, Medicaid Division, in developing the new program and rules, specifically the Children's Redesign Program. IOTA is monitoring rules for all changes to implementation and reimbursement of all therapy services.

March 14, 2011 - House Bill 260 passed the House Health and Welfare Committee and advances to the full House.

March 14, 2011 - The House Health and Welfare Committee has drafted new legislation regarding Medicaid and the previous HO221. It will be introduced at 1:30 in the House H&W Committee Meeting on March 14.

Rules for the licensure of occupational therapists and occupational therapy assistants   IOTA supports the temporary and proposed rules.
The Occupational Therapy Licensure Board has drafted temporary and proposed rules to clarify rules relating to inactive license status, reinstatement procedures, supervision and continuing education requirements for use of physical agent modalities in occupational therapy practice.

Children's System Redesign for Medicaid   IOTA supports the proposed changes.
Idaho Medicaid has invited stakeholders including the Idaho Occupational Therapy Association, Idaho Physical Therapy Association, Idaho Speech and Hearing Association, Special Education Directors, and Developmental Disability Agencies to provide input in a system to redesign services for children that will be more family-centered. The process is ongoing.

  IOTA has found the process to be inclusive and encourages the continuation of discussion in an effort to provide the appropriate level of therapy services to clients at the appropriate time.

2010 Legislative Session
Medicaid Rules for school-based therapy services   IOTA supports the proposed rules.
Medicaid Rules are being updated to be in compliance with the Occupational Therapy Practice Act and all statutes regarding therapy services.

Rules Governing Occupational Therapy in Idaho   IOTA supports the proposed rules.
With the creation of the Occupational Therapy Licensure Board at the Idaho Bureau of Occupational Licenses, Governor Otter appointed new board members effective July 1, 2009.  They immediately began writing the Rules Governing Occupational Therapy in Idaho.

2009 Legislative Session

Occupational Therapy Practice Act

  IOTA supports this bill.
IOTA began working on revisions to the Occupational Therapy Practice Act on August 3, 2008. The proposed revision combines the current Idaho OT Practice Act with the AOTA Model Practice Act.  On October 18, all OT practitioners were invited to participate in an interactive session to review the proposed changes.  A Practice Act Task Force emerged from that meeting. 

It has been reviewed, revised, discussed and deliberated by OTs and OTAs from all practice areas and clearly represents the scope of practice for occupational therapy that will ensure delivery of the highest standards in client care. 

The Occupational Therapy Act:

• Amends the OT Practice Act that was first adopted in 1988

• Sets forth in law the national model language so there is consistency in OT practice from state to state

• Provides continuing education, supervision and disciplinary requirements

• Moves the Licensure Board to the Bureau of Self Governing Agencies (Idaho Bureau of Occupational licenses) along with the other allied health professions

April 2 - 10 am  Third Reading Senate

Although HB 261 was assigned to the Senate Calendar on this date, it will be several days before it is debated on the Senate Floor.

March 30 - The Senate H&W Committee Committee voted unanimously to send the bill forward to the full Senate with a do-pass recommendation.

March 26 - Passed by House 67-0-3

March 23 - The House Business Committee voted unanimously to send the bill forward to the full House of Representatives with a do-pass recommendation. 

March 20 - The OT Practice Act Legislation is assigned number HB 261.

 ALERTDOCKET NO. 16-0309-0803 IOTA opposed this change.

IOTA has learned that changes have been proposed to the Medicaid rules affecting Medicaid Basic Plan Benefits for mental health.  Specifically, occupational therapists are being eliminated as providers that may be paid for providing services as staff in a mental health clinic.

AOTA and IOTA representatives attended the public hearing on October 17, 2008 and voiced disagreement with the proposed rule change as did many other stakeholders.

The proposal did not come forward to the 2009 Legislature and to our knowledge no further action has taken place.

We are reviewing proposed rules for 2010 and will advise if this proposal reappears in any form.
